| Gebietstyp | Tag (6–22 Uhr) | Nacht (22–6 Uhr) |
|---|---|---|
| Reines Wohngebiet (WR) | 50 dB(A) | 35 dB(A) |
| Allgemeines Wohngebiet (WA) | 55 dB(A) | 40 dB(A) |
| Mischgebiet (MI) | 60 dB(A) | 45 dB(A) |
| Gewerbegebiet (GE) | 65 dB(A) | 50 dB(A) |
Bis Ende 2025 reichten 5 dB(A) Unterschreitung.
|---|---|---|
| bis 6 kW | 65 dB(A) | max. 55 dB(A) |
| 6–12 kW | 70 dB(A) | max. 60 dB(A) |
| 12–30 kW | 78 dB(A) | max. 68 dB(A) |
Was Kommunen zusätzlich verlangen können
Heat Pumps and Neighbour Law: Noise, Distances and What Municipalities Can Require
Two Sets of Rules – a Common Misunderstanding
Anyone planning a heat pump operates in two completely different legal worlds at the same time: the state building codes (Bauordnungsrecht) regulate distances to the property boundary and permit requirements. The Technical Instructions on Noise Protection (TA Lärm) set out, with nationwide binding effect, how loud the system may be at the neighbour's immission point. Since January 1, 2026, there is also a third level: the tightened KfW (Reconstruction Credit Institute) noise requirement, which is purely a funding condition. Anyone who confuses the three levels risks neighbour disputes, fines or the complete loss of funding.
TA Lärm: The Relevant Limit Applies at the Neighbour's Window
TA Lärm is the central instrument of immission control law for technical installations. The decisive point: measurement is not taken at the heat pump's outdoor unit, but 0.5 m in front of the most affected window of the neighbouring house. The immission guide values depend on the type of area (as of: TA Lärm in the 1998 version, last amended 2017):
| Area type | Day (6 a.m.–10 p.m.) | Night (10 p.m.–6 a.m.) |
|---|---|---|
| Purely residential area (WR) | 50 dB(A) | 35 dB(A) |
| General residential area (WA) | 55 dB(A) | 40 dB(A) |
| Mixed area (MI) | 60 dB(A) | 45 dB(A) |
| Commercial area (GE) | 65 dB(A) | 50 dB(A) |
In practice, the night-time value is the decisive hurdle: typical air-to-water heat pumps generate a sound pressure level of 50–62 dB(A) directly at the unit. By the time it reaches the neighbour's window, this value is reduced by 15–25 dB(A) through distance attenuation – however, the geometry of the installation location (wall reflections, directional sound radiation of the fan, corner situation) can eat up this advantage again. Anyone living in a purely residential area who installs the unit directly at the boundary can hardly physically meet the night-time value of 35 dB(A).
Important: If the system complies with the TA Lärm limits, the neighbour has no claim to cessation under current case law – even if they subjectively perceive noise.
KfW Noise Requirement 2026: A Relative Funding Value, Not an Absolute Ban
Since January 1, 2026, a tightened noise requirement applies in KfW programme 458 (heating funding, BEG): the outdoor unit of an air-to-water heat pump must be at least 10 dB(A) below the limit of EU Ecodesign Regulation No. 813/2013. Until the end of 2025, 5 dB(A) below the limit was sufficient. The decisive factor is the date of application: the requirement applies to applications received by the KfW from January 1, 2026.
The specific funding thresholds (sound power level LWA outdoors) by capacity class (as of: 01.01.2026):
| Rated heat output | Ecodesign limit LWA | KfW funding threshold (−10 dB) |
|---|---|---|
| up to 6 kW | 65 dB(A) | max. 55 dB(A) |
| 6–12 kW | 70 dB(A) | max. 60 dB(A) |
| 12–30 kW | 78 dB(A) | max. 68 dB(A) |
Caution – two common mix-ups:
- The KfW value is a sound power level (LWA) at the unit – a device characteristic stated in the manufacturer's data sheet (according to EN 12102-1).
- The TA Lärm limits (35/40 dB(A)) are sound pressure levels at the immission point – that is, a measurement that differs in both location and time.
Anyone who installs the wrong unit loses the funding entitlement entirely. However, heat pumps that do not meet the noise threshold may still be installed – the KfW requirement is a funding condition, not an installation ban.
Building Codes: Distances by Federal State
Building law is a matter for the federal states and has changed fundamentally since 2022. In 13 of 16 federal states there is now no statutory fixed minimum distance for household-standard air-source heat pumps – typically up to 2 m in height and 3 m in length per side of the property. For single-family and two-family houses (building classes 1 and 2), installing a heat pump is exempt from procedure nationwide, i.e. possible without a building permit.
Exceptions and special cases (as of: autumn 2026):
- NRW: Entirely exempt from distance requirements since 01.01.2024 (§ 6 BauO NRW); no building permit for standard units.
- Bavaria: Exemption from distance requirements for units ≤ 2 m in height since 01.01.2025.
- Berlin: Strict special case – a 3 m minimum distance to the property boundary still applies.
- Saxony-Anhalt: A minimum distance of approx. 3 m is still recommended.
- Ground-source and groundwater heat pumps: A water law permit is always required, regardless of the federal state.
Rule of thumb: Even if no minimum distance applies under building law any more, TA Lärm determines the actual minimum distance. Installation directly at the property boundary is only permissible if the immission guide values at the neighbour's window are still met.
What Municipalities Can Additionally Require
Municipalities can impose independent requirements via the development plan (Bebauungsplan) or monument protection conditions. If the building is located in a monument protection area or the development plan sets particular design rules, even a heat pump that is otherwise exempt from procedure can become subject to permit requirements. In such cases, compliance with noise protection requirements must be demonstrated on a case-by-case basis – especially for installation close to the boundary. Enquire in advance with the responsible building or environmental authority of your municipality.
Obligation for all heat pump types: Registration with the grid operator as a controllable consumption device under § 14a EnWG has been legally required since 2024 and is also a prerequisite for KfW funding.
Practical Planning Tips
- Check the data sheet: Have the sound power level (LWA outdoors, according to EN 12102-1) confirmed in writing – not the "silent mode" value, which only applies in a particular operating mode.
- Installation location first: The location often influences the sound level at the neighbour's window more strongly than the choice of unit. Wall reflections in corners can increase the level by 3–6 dB(A).
- Plan for night mode: Many units offer reduced night operation; however, this is no substitute for professional installation planning.
- Noise protection measures: A sound insulation hood can bring up to 10 dB(A) and is worthwhile on tight plots.
- When in doubt: commission a noise forecast. A specialist company or an accredited measuring body can calculate the expected immissions at the neighbouring property before the unit is installed.
