Todesfall bei laufender Förderung: Was Erben jetzt tun müssen
Der Anspruch bleibt also bestehen.
Hinweis

Death During Active Funding: What Heirs Must Do Now
Funding does not end with the death of the applicant. The grant approval notice passes to the heirs by way of universal succession under § 1922 BGB (German Civil Code) — with all rights and all obligations. The entitlement therefore remains intact. It simply needs to be transferred, and there is a deadline for this that waits for no one.
What to do first
Notify the funding authority of the death as soon as you are in a position to act. An applicant transfer is possible, even if the grant approval notice has already been issued.
According to information from BAFA (Federal Office for Economic Affairs and Export Control), the following documents are required:
- the death certificate
- a certificate of inheritance or a notarially certified document confirming who is entitled to inherit
- in the case of a WEG (homeowners' association) or inheritance community: additionally, a power of attorney from all entitled heirs and the designation of a single point of contact
If the project remains unchanged in substance, the application is continued under the new applicant's details. A new application is not required — and would in fact be detrimental, as it would invalidate the original approval.
The issue that costs the most money
Deadlines keep running. A death does not suspend the approval period.
For BAFA-EM (BEG-EM) individual measures, the approval period is 36 months from receipt of the notice. The proof of use must be submitted within six months of project completion, and no later than six months after the end of the approval period — giving a maximum of 42 months. For heating system replacement via KfW, separate deadlines apply; the decisive reference is always the individual approval notice.
In practice, months can pass between the death, the issuance of a certificate of inheritance, and reaching agreement within the family. If the approval notice is already two years old, time becomes very tight. For this reason: identify the deadline stated in the approval notice before attending to anything else. Whether and when an extension may be granted is a separate matter — and opinions on this vary.
Inheritance community: one point of contact, all signatures
Multiple heirs can only jointly dispose of the estate. For the funding authority, this means: a power of attorney from all heirs, plus one designated person to manage the process. This person handles all communication, submits the proof of use, and serves as the point of contact for any queries.
A practical note: clarify early on which bank account the funding should be paid into. The deceased's account is often frozen after death. The bank details must match those of the new applicant — otherwise disbursement may ultimately fail over a procedural formality.
What happens to the bonuses
This is where the greatest risk lies, and it is regularly overlooked.
The Climate Speed Bonus and the income bonus are conditional on the owner occupying the property themselves. If the heirs do not move in but instead rent out or sell the property, these bonuses may be forfeited — including retrospectively. Amounts already disbursed may then be reclaimed.
You should therefore proactively report any change in use, rather than hoping it goes unnoticed. A discrepancy discovered after the fact carries greater consequences than one that was declared voluntarily.
A sale of the property before the project is completed should also be discussed with the funding authority in advance — not after the fact.
If the measure is no longer going to take place
In that case, inform the funding authority. The approval notice will be revoked and the reserved funds will be returned. If amounts have already been disbursed, these must be repaid — which is unpleasant, but is a defined process.
Doing nothing is the worse option: if the deadline passes without proof of use being submitted, repayment will be demanded regardless — but without any room to negotiate.
If the death occurred before the application was submitted
In that case, there is nothing to transfer. The heirs must submit their own application — and the fundamental rule applies without exception: application first, then the contract. If the tradesperson has already been commissioned, the funding for that measure is lost.
It should also be checked whether a contract was actually concluded at all. If a tradesperson orders materials without a signed contract, there is generally no payment obligation. This is a question of contract law and belongs with a solicitor, not with the funding authority.
Tax considerations
The tax relief under § 35c EStG (German Income Tax Act) is tied to the individual and to owner-occupation. It does not form part of the estate and does not pass to the heirs. Anyone wishing to claim the measure for tax purposes must meet the eligibility requirements in their own right.
Note
The information provided reflects the status of the funding guidelines as of July 2026. The documents required by the funding authority in any individual case depend on the programme and the specific circumstances — the binding reference is the funding authority's guidance for your particular case. Questions of inheritance law should be directed to a notary or a law firm.
A funding case within an inheritance community is complex enough on its own. For BAFA (Federal Office for Economic Affairs and Export Control) projects, Energieberatung Klein GmbH acts as authorised representative of the heirs, handles the applicant transfer, and manages the entire process through to disbursement — including reminders about deadlines. For KfW projects, heirs act independently; we help you prepare.
